  3. Examine the scope and significance of the International court of justice’s (ICJ’s) jurisdiction. Also examine how has India benefited from ICJ.

    International court of justice (ICJ)is principal judicial organ of united nations. It was established in June 1945 by charter of United Nations began work in April 1946. The seat of the court is at the Peace Palace in The Hague(Netherlands).
    The International court of justice has two functions :-
     To settle , in accordance with the international law, legal disputes submitted by States , and
     To give advisory opinion on legal questions reffered to it by authorised by UN organ and specialized agencies.
    Procedure of selection:-
    Five of 15 judges of the ICJ are selected every three years. This year , there were 6 candidates for five places .the winning candidate require a majority in both the UNGA and UNSC, in simultaneous voting through secret ballot. India won in both in the UNGA and UNSC, in multiple round of voting.
    For the first time, the U.K will not have a judge on the ICJ. First time that a permanent member of the united nation security council has lost ICJ on vote. This is major diplomatic success of India in ICJ.for in it is clear to find a louder global voice, it also help in solving kulbushan yadav case. India have big opportunity to express his views on many subject on global table. India need to put more emphasis on ties with countries away from high table.

    – 1952 से 2014 तक 668 बार जारी ,अकेले बिहार में 256 बार,( राज्यपाल जगन्नाथ कौशल द्वारा 1 दिन में 58 अध्यादेश जारी)

    5)पंचायती राज 73 वे सविधान संसोधन,1992 के तहत सविधान में जोड़ा गया
    – अनुच्छेद:- 243 से 243 ण तक
    – सबसे पहले आयोजना का उदघाटन जवाहरलाल नेहरू जी द्वारा 2 अक्टूबर 1959 में राजस्थान के नागोर जिले में
    – पंचायती राज से अभिप्राय स्थानीय स्वशासन से है
    – नगर निगम निकाय शासन प्रणाली को 74 वे सविधान संसोधन,1992 के तहत सवैधानिक दर्जा प्राप्त हुआ

    – पहला नगर निगम 1687 से 1688 में मद्रास में स्थापित

    9) व्यपगत का सिद्धांत :- इस नीति का प्रयोग लार्ड डलहौजी द्वारा (1848 से 56) किया गया इसे *शांति पूर्ण विलय की नीति * के नाम से भी जाना जाता है
    – इस नीति के तहत विलय होने वाली पहली रियासत सतारा,1848 तथा अंतिम रियासत अवध,1956 थी

  7. International Court of justice( icj) was formed by the UN Charter in 1945. But it started working in 1946.
    Hq- the Hague, Netherlands
    Objective- to maintain peace among the countries.
    Jurisdiction
    1) All the UN members are automatically parties to the ICJ statute.
    2) The non UN members are parties to the ICJ statute. For eg. SWITZERLAND.
    3) States can also be parties to the ICJ statute but their case will not automatically have court jurisdiction over the disputes involving those parties.
    4) So the ICJ divided these issues into two opinions-1) contentious opinion for states only. And 2) advisory opnion for all including the 6 UN organs(Union nations general assembly, United Nations Security council, economic and social council, secretariat and trustship council)
    5) No appeal is possible however the party may clarify if there is a dispute as to the meaning or scope of the court's judgement.
    India's benefits from ICJ
    1)1954- Portugal had asked for Darta and Nagar Haveli. ICj' s decision in favour of India.
    2)1999- Pakistan's Claim over Atlantique aerial against India. ICJ remained silent.
    3) 2013- Pakistan claimed over kisan- Ganga project. Again ICj's decision in favour of India.
    Conclusion- India has won on all terms through its skilled diplomacy.

  9. ICJ is principal judicial organ of UN based in Hague, Netherland.it consists of 15 judges regardless of their nationality and every 5 judges elected every 3rd years for the tenure of 9 years
    Purpose of the court:
    The court settles legal disputes submitted to it by states and provides advisory opinion on legal questions submitted to it by duly authorised international branches, agencies and the UNGC.
    Article 36(2) of the statute of ICJ requires that a matter brought before it must be legal dispute
    ICJ enjoys contentious, compulsory, and advisory jurisdiction.
    a) contentious jurisdiction: this type of jurisdiction of icj founded upon the consent of the parties.
    b) compulsory jurisdiction: it says that the state parties to the present statute may at any time recognize as compulsory the jurisdiction of icj in all legal disputes.
    c) Advisory jurisdiction: in its advisory, the court may give advice to the UNGC, UNGA or any member state as the case may be.
    India benefited from ICJ:
    As recently Dalveer Bhandari has been appointed as one of the 15 judges of ICJ. Obviously, India will be helped although the judge of the ICJ whether belong to any nationality, who would have to work independently and impartially but still there would be sympathy for own country. He will help in release of Indian navel officer kulbhushan from Pakistan jail.
    As terrorism is spread across the world and most of the country knows that Pakistan is terrorist sponsor hub and Masood Azhar is Pakistan based terrorist. Many times UN tried to designate Masood Azhar as world terrorist
    While China using veto power let him free all time without designating him world terrorist.
    Now there will be more change to put him behind the bar.

  10. examine the scope and significance of international court of justice. also eamine how idia has benefited from the international court of justice:
    there are 6 major organs of UN , 5 of them are having there headquater in the newyork city except one that is international court of justice. ICJ is a principal judical branch of UN , seated in the peace palace in the hague netherland/holland. it was established in 1945 by the charter of UN and started working in 1946. it is a successor of the permanent court of international justice formed in 1922 under league of nations and got dissolved in 1946 giving its way for ICJ.
    its area of jurisdiction:
    1- it dcides contentious cases in accordance to the international laws , and it takes the disputes of the legal nature that are submitted to it by the states.
    2- advisory proceedings: here it gives advisory opinions on legal questions at the request of the members of united nations or other specialized agencies which are also authorized to make such requests.
    In the recent case of kulbhushan jadav for which india has approached international court of justice, it comes under contentious cases and india has asserted thath pakistan has violated its obligations and the viena convention on consular relations as pakistan has refused to allow counsellor access to jadav following an arrest of him in pakistan.
    composition of ICJ:
    it consist of 15 judeges…term of office is 9years..they are elected by the un general assembly and the security council…they vote simultaneouasly but seperatly…..1/3rd of the court is elected every 3years , or we can say that 1/3rd of the judges get retired every 3 years , this to mantain the continuty of the court….judges are also eligible for re election.
    it is a unique judicial institution,whose role is to deal with the legal problems of the international community as a whole. the court is a key part of the mechanism for maintaining international peace and security established by the charter of the UN.
    it is no doubt, true to sAy that one of the issues that has most troubled the the world this century is the task of finding the international institutions that can guarantee peace and security among nations.
    how india has benefited from the international court of justice:
    – in 1954 portugal asked for a passage to dadar and nagar haveli but the decision ruled in favour of india
    -in 1971pakistan on jurisdiction of international civil organisation over india's territory in wake of 1971 hijack issue , this time decision ruled against india , hence india brought clauses in 1979 to avoid pakistan to drag her repeatedly.
    -in 1999 , pakistan's claim over atlantic aerial issue in rann of kutch and ICJ said that it has no jurisdiction on this issue.
    -2013-2014 kishan ganga project ruled in favour of india against pakistan.
    2014-2015, marshall island draged india over obligations concerning nuclear disarmament in process.
    India has got a lot of benefit from the international court of justice on many issues especially on issues raised by our not so friendly neighbours.

  11. The state of UP was envisaged to be divided into 4 regions- paschim pradesh, purvanchal, bundelkhand,awadh pradesh by the then C.M. Mayawati. The idea of Panchayati raj is also included in the DPSP
    The 73rd and the 74th amendment of the Indian constitution deals with the panchayati raj and municipality
    The citizenship is included in the 2nd part of the constitution from articles 5 to 11.

    Article 280 of the constitution of India deals with Finance commission. It is constituted by the President of India for a term of 5 years or early as he may consider necessary. The FC consists of a chairman and four other members (it also includes a judge of a high court). The chairman of the 14th finance commission was the former RBI governor YV Reddy. Its term was from 2015 to 2020.

    In some places we have to pay 600rs or 800rs only for checkup, but seriously not everyone is capable of paying it…specially with the students also.

  13. ICJ benifita for india. .
    -now it should be clear that the Indian victory in no way means that India has planted its flag at the ICJ. As a member of the court, Bhandari does not serve India’s interests but those of international law. The expectation that having an Indian representative at the ICJ will help India in the Kulbhushan Jadhav case with Pakistan, is misguided. Under ICJ rules, if the bench in a case includes a judge who is a national of one of the parties, the other may nominate an ad hoc judge to the bench. Last month, Pakistan appointed its former chief justice, Tassaduq Jillani to the ICJ. Having taken the case to the ICJ, India has to now play by its rules.. .
