  2. Women security: Role of Education and Law.

    Introduction:
    यत्र नार्यस्तु पूज्यन्ते रमन्ते तत्र देवता:
    Violence against women is becoming a very dark topic to be addressed in India.Thousands of women and girls are mainly victims of gender violence. The recent report of NCRB shows that the crime against women has seen an increasing rate of 34%. There are several reason behind these crimes like socially unprotective environment, lack of education, bad implementation of laws, lack of governance, political agendas, religious and spiritual factors etc. But our of these areas of concern, Education and A strict and effective framework of law can eliminate the wide amount of criminal activities. But as we know that there are several loopholes in our educational and legal infrasture, due to this we have failed to stop these heinous crimes.

    How do the lack of education and law increase the severity of the situation?
    1. Education:
    -> Education is the very basic element which can develop morals and ethics in human beings. An educated person will always be aware of his roles and responsibilities towards the society.
    -> In the recent case like Kathua and Nirbhaya, we have witnessed that most of the time our young population is involved in the criminal activities. So we should consider the importance of education by these examples only. A well-educated society will provide better chances grow and people will not get indulge in such criminal activities.
    -> According the reports. 65% men in India consider the violence against the women a legitimate reason to keep the families happy and together. Also around 25%, men of India have committed some kind of sexual violence in their life. We can not say that these many men of society are illiterate but they didn't get the value out of their education, we have to focus on the role of education also.
    -> Education is a very good way to make our people responsible towards the society and they can help in building a women-friendly environment.
    -> Honour Killings are many times seen in the news and they mostly happens and the village area. The main reason is the lack of education. People are still considering the so-called traditions and rituals better than freedom of living.
    -> Apart from providing the regular technical education in the schools, we should give equal importance to the sex education. Not in just school, we have start talking about these matters our families and society.

    2. Law and Order:
    -> Recently our government has passed an ordinance of making a provision of death penalty for those people who found guilty in the rape case of any girl who is less than 12 years old. Before this statement states Haryana, Rajasthan etc has already passed a same order in the respective states.
    Apart from this, we have several laws in our country to right the violence against women:
    – POCSO act of 2012.
    – The act of 2005, to prevent the domestic violence again women.
    – Beti Bachao Beti Padhao Andolan
    – The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013
    -> These laws are created in order to create a deterrence in the society to prevent the crimes against the women.
    -> Law and Order is a very much necessary condition. It is the primary weapon to fight the crime and also it makes a responsible environment around the nation so that people will follow the rules and regulation in order to provide security measures.By a well-defined law in the society women will feel safe and secure and they will have the freedom to choose the right place and path to live the life.

    But where do we fail?
    – Even though we have several provision for education and many laws to prevent the crimes against the women, we have failed to prevent them all. Some reasons are as follows:
    -> Even though we are providing a better infrastructure for education day by day but we are advancing in terms of social morality and responsibilities. We can take the example of the recent case of Kathau where a student was also involved in the crime.
    -> Our educational framework has still not designed a good framework for sex education and talking about these subjects still considered a bizarre.
    -> Despite several laws we lack in one single factor, the flawless implementation of the law. Even in the recent cases, our leaders are also involved so how we can say that we are able to create a protective environment for women.
    -> Even by very hardships or because of the pressure of the society if police capture an accused person, the cases take years to be cleared out from the courtroom.
    ->There is no provision for the fast disposal of the cases. People are not well aware of the laws.
    -> due to lack of education and awareness sometimes the cases do not come out and whichever cases out, they are just becoming new files to be read after years and decades.

  5. Q: Can Education and legislation Address Violence Against Women and Children In India ?
    Ans: “To call women the weaker sex is a libel; it is man’s injustice to women. If by strength is meant moral power, then women is immeasurably man’s superior. Ha she not greater intuition, is she not more self-sacrificing, has she not greater powers of endurance, has she not greater courage? Without her, man could not be. If nonviolence is the law of our being, the future is with woman. Who can make a more effective appeal to the heart than woman?” :— Mahatma Gandhi Ji
    Approach/essence of thoughts of Mahatma Gandhi ji about women to say is that if a person is going to become a success person in his life, somewhere, you will find a great mother, sister, daughter, wife standing behind him, it would be interesting to know how many great women have had great fathers and husbands behind them.
    Before moving ahead in near future and starts talked about present, our history is an evidence and telling all about discrimination with women that were happening there in history, also that there were no chance to gives full right to women even in Ancient History or Medieval History there were discrimination or heinous crime that always happening with the women in that times as well whether women belongs to upper class or lower class, most of crime or heinous had been happening with the lower class women. It directly show that the discrimination were on the basis of cast, race, economically and gender. There were not have rights to women for participation in any of the occasion, no access to franchise rights and education were also not accessible to them.
    Moving towards that time after since independence, while making of the constitution our constitution makers has made our constitution in the respect of every citizen of India and they had made FUNDAMENTAL RIHTS, DUTIES, OR many more things and overthrow discrimination from the India, they made everything would be accessible to every person even a person belongs to any cast, races, gender or economy. They had provided equal rights to every citizens of India. And then after that they were think about that now India will grow in real manner. Although they have made constitution and give access of FR to each citizen but somewhere discrimination is already prevalent within the society in India.
    Indian society still unable to gets their RIGHTS, DUTIES, due to lack of education, if we takes a look about illiteracy rate of India, it is around 75%, but in real manner many citizens of India already deprived mostly women to education despite of The Right of Children to Free and Compulsory EDUCATION ACT OR RIGTH TO EDUCATION ACT (RTE) it is enacted within the country by 2009 to providing education to children’s under age of 6-14year.

    Now, moving towards present day situation of Indian society. We found that discrimination is already prevalent with in country, despite of legislation.
    Nirbhaya incident, A girl was travelling in the bus with her friend. She was brutally and thrown away form the bus and her friend was also heinously injured for trying to stop them. In the kathua, some police officers cruelly raped a 8 year old girl, and killed her, and in Unnao, a legislator raped the girl and her father killed in the police custody. At public places, workplaces, bus stops, park, in movie studios in the name of casting couch, violence against women and Children happening form Generations.
    And then after Nirbhaya incident, criminal law amended to punish the perpetrators severely and court awarded death penalty for rapists. Then also, violence against women couldn’t be overcome, after we seems many incidents within the states of Haryana, Banglore, Mumbai, Chennai etc, and incidents such as UNNAO and KATHUA, etc. For the women we can says that there is not place where they can feel safe, neither school nor home, or public place because there are many incident happening by their relatives or school teachers. In there context to tackle with the all heinous we must have need to have first broader analysis to understand the impact of law and education to reduce the violence against women.
    To understand the impact of law and education, first we need to know the reason for violence upon women and children’s, violence take place in homes, schools, society due to cast, religion, and races.
    Today’s we must have need to spread awareness or provide education to every person even a children or a adult or old there is no age defined for gets education because, “ EDUCATION IS THE MOST POWERFUL WEAPON THET WE CAN USE TO CAHEN THE NOT EVEN THINKING OF A PERSON BUT ALSO WE CAN CHANGE THE WORLD WIHT THE ACCESSIBLE OF EDUCATION TO EVEY PERSON” or to tackle with it awareness, and education not only should spread broadly but as possible as upto individually. Because legislation only can work in one side it can not change thinking of a person, as today’s within India has POCSO ACT for children’s protection and Criminal low ACT for adult, in some states of India already given death penalty to rapist for under the age of 12 year and cabinet have increased the conviction rate for rapist for age 16 year. When if we make them more strict but fist we have need to keep that in our mind not only single one thing even a legislation or education can change it both of them legislation or education must have to works together.
    On the one hand government have need to implement law on ground level as government have issue the women helpline number 1091, and gradually making public place secure for women and also government have need to make accessible education for women mostly in rural areas because this cases extract mostly form rural areas.
    Despite of legislation there must be to implement free education at ground level for women to abolish violence against them, and also need to making laws more strict to create deterrence with in the conscience of a man.
