I am deeply in pain after experiencing this; First of I would like to know you that I belong to SC/ST Community.
Last night on The Hindu app I posted my views on SC/ST act, there were already so many views from Brahmins but rarely was from SC/ST. I thought my views would be posted and but it was not posted till today morning. I reposted the same views in morning but nothing was posted. Not only this there were so many views from upper castes after yesterday night but they did not post my view. Two days ago too one of my view was posted but after so many modifications!
I wonder here only they are discriminating so much, what do they do with SC/ST in real life. They just post what they want to hear. This is so much disappointing, right to speak and express is for all not merely for selected people 🙁
Well here is my view that i wanted to post on TheHindu app:
"More than 11 people have been killed and public properties are turned into ashes, heartbreaking news of such violence comes around nothing is felt except a deep pain.
Whether it is Bhima koregaon violence or Bharat band. Always Dalits are targeted and brutally killed.
There were many protests from upper castes(I don't want to name any, everybody knows it) in past and many will be taken place but nobody gets killed. Whenever a Dalit community wants to speak up for their rights, it can't be digested and they are suppressed on a large scale. Although I am strictly against anykind of protest and discontinuing daily life, but here I am trying to say is, how always Dalits are victim of social evilness, everybody see/hear this but no-one seriously thinks about it.
Moreover Pradeep Rather unna, Rohit Vemula, Dilip Saroj, Madhu Chindaki are those who were harassed and killed recently. The only reason is they belong to SC/ST/Other backward classes. How can right to equality and right to live life with dignity be applied, if there will be no life anymore.
Dalit wants nothing but a peaceful and secure life.
Why can't supreme court bring a fair judgment, where access of judiciary would be easy and fake people as well as guilty would get strictly punished"

SC/ST act and the chaos around:
Our society was divided into several caste and groups in the past and but the major bifurcation which we see in today's time is between the Depressor and the Depressed class of the society. SC and ST category has been considered as the depressed class and in some measure, it is true also. We should thank the education which has helped these people a lot to know about their rights but still there a very large segment of depressed people in Indian society. According to the census of 2011, population share of ST and SC are 8.5% and 16.5% respectively. These people are most backward in terms of education, health, social status, living status, income measures etc.. Our constitution also provides the safety measure for these people so that they can go with the mainstream of the society and equal opportunities should be delivered to these people.
– Article 15 empowers the state to provided special measures for the backward section
– Article 17 is about the abolition of Untouchability
– Article 19 is about the freedom'
– Article 21 comes with a power of life with dignity
– Article 46 of DPSP is about the protection from of SC and ST category from any kind of misbehavior.

Our Government has recognized the status of this category and introduced the SC and ST (protection from atrocities) act 1989.This act has a power to create a deterrence to stop the misbehavior again the depressed class. It empowers the backward people to fight for their dignity of life and provides a legal treatment related to the atrocities.
Recently our respected SC has provided some guidelines to stop the misuse of this act and it is to be noted that they didn't amend the act. SC has given the reason that these measures are necessary to create a fair legal treatment for every segment of the society. but somehow these recommendations make the legal aid hard for the SC and ST.

What will be the negative side of SC judgment:
– The NCRB report has given a fact that report fired in this act has been increased by 5.5 % from 2015 to 2016. Most of the cases are related to women and rape. So diluting the power of the act will give the spark to these crimes and the deterrence which is there in the society will decrease.
– One more thing is that SC has directed to the authorities to arrest only after taking written permission from the appointing person and in case of private employees they have to take the permission of SP of the area. These rule can make a huge impact on the depressed class. These people are not that much empowered and mostly illiterate and belong to low-income segments. There is the high possibility that after seeing the complex system they can drop the idea of firing any FIR.
– People which belong to SC and ST are much educated and not aware about the rights properly so making the procedure even more complex is like denying the justice because the corruption in the society is well known to the higher authorities will not act accordingly.

Why are these recommendations necessary?
– Supreme has suggested that the act has become an instrument of blackmailing the people so there is an increase in the false cases. As the NCRB data suggests that a large percentage of the cases fired are false. So if don't proceed with a proper inquiry first then there is a chance of huge mistake. So SC wants to save those people who are being trapped using this act.
– Anyway, if the case is true then inquiry will justify that so we should think that these recommendations will decrease the power of the act. SC has not amended the act but it has given the implementation guidelines.

Conclusion: Purpose of SC was good but the same time we have to rethink the data which are being provided. There is a huge gap in the actual implementation. Our authorities not acting fast over these incidents and the crime is increasing day by day. The person who is innocent they should not feel any fear from this act but the same time we have think about the social status of those people which will be spoiled after a false case. If we implement the SC guidelines and the acting authorities are efficient enough about the disposal of the act then noway we can see that the act has lost his power. So it is not about the guidines which has been framed but it depends on the path on which they are being implemented.
