7) What are the important functions of Finance Commission? Do you think Finance Commission is functioning as an arbitrator between the Union and State governments? Critically examine.
A finance commission is set up very five years by the President under Article 280 of the Constitution. Its main function is to recommend how the Union government should share taxes levied by it with the states
Important Functions of finance commission are as follows.
1. To distribute taxes between Center and State as per their contribution
2. To determine the factors which govern Grant-in-aid to states
3. To make recommendation to President for utilizing the fund for usage in Panchayats and Municipalities on the basis of recommendation made by the state finance commission
4. To recommend President about any other factors related to State Finance commission

Finance commission plays a role of arbitrator between the center and the state because
1. It helps to distribute taxes between center and state
2. It provides Grant-In-Aid to states in case of revenue shortfall
3. It establishes a perfect method for devolution of aid in the states
Previous finance commissions used to provide Central Financed Schemes (ex. Say education). But few states started complaining that the formula used for devolution treats the states on unequal grounds.
Also Planning Commission (which is an non-constitutional and non-statutory body) used to overshadow the recommendations of Finance commission.
Now that the NITI AAYOG has came instead of planning commission The suggestions concerning making Finance commission a permanent, constitutional body, can be taken into account, as it will further strengthen its position in the sphere of financial administration.
So Finance Commission plays the role of an arbitrator in limited ways.

What are the important functions of Finance Commission? Do you think finance commission is function as an arbitrator between the Union and State Government? Critically examine (150 -250 Words)
Solution:
“Finance Commission” is Constitutional and Quasi-judicial body. The provision of it is given in our constitution under Article 280 & 281.It is advisory in nature. It is constituted by the president in every five years or earlier time when president feel it necessary. Finance commission recommends to president on following matters and these are important functions of it.
i. Vertical devolution of Taxes from Centre to State
ii. Grant-in-aid by Centre- from “consolidate fund of India”
iii. Augment aid to Panchayat and Municipality on the “state finance commission” recommendations
iv. Whenever President feel about the “Sound Finance”, can be done through Finance commission
Do you think finance commission is function as an arbitrator between the Union and State Government?
Yes, Finance commission is act as agent/arbitrator between the Centre and state during monetary transaction and balancing the “fiscal federalism”. In the 14th Finance commission, 42 % of total pool will be given to state under the finance commission recommendations. Once amount (42%) is allocated to states pool then the same amount will be distributed among the state (Horizontal devolution) as per certain criteria.
Those criteria are below:
i. Population of state
ii. Hilly terrain or Forest cover
iii. Area
iv. Fiscal discipline
v. Income distance

Conclusion:
“Finance commission” and “Planning Commission” are the two body which balancing the fiscal federalism concept in India. Now Planning commission’s name has been changed to NITI Aayog.NITI Aayog more concentrate on Planning and development prepared by “Think-Tank” where as Finance commission played vital role in Vertical and horizontal fiscal Transactions. Both are played as important component for proper administration and growth of States and enhance the concept of “cooperative federalism”.
