Is mens rea required for civil wrong too??
also an act becomes a tort only if mens rea is present ,but in tort of negligence, most of the time mens rea is absent..
@14:00,a defendant is responsible for the tort of negligence only for the duty he owes to the plaintiff, and here the defendant must be hired for that specific task to perform, a citizen who forgot to close the door of the bus should come under moral duty rather than legal duty no??
