  9. Two grounds mention in our constitution for the removal of judges ..one is misbehaviour and other is incapacity.
    Procedure:
    A motion for the removal signed by 100 members of Loksabha and 50 members of Rajyasabha must be presented to speaker/ chairman of the house.
    Speaker/ chairman may admit or refuse to admit the motion.
    If admitted the speaker/ chairman would constitute a 3 member committee to investigate the charges.
    The committee should consist of Chief Justice of SC , Chief Justice of HC and a distinguished jurist.
    If the committee finds the judge guily , then the house would take up the motion for consideration.
    The motion must be passes with special majority of 2/3rd of members present.
    Then the motion would be passed before the president who would pass the order of removal.

Both the Supreme Court and High Courts Judges are remove in the same process and the only difference is that Supreme Court Judges remove under article 124 and High Court Judges under article 217 on the grounds of misbehavior and incapacity under Judges Enquiry Act (1968). The Process of Removal of Judges of Higher Judiciary are : (1) Under Judges Enquiry Act (1968) the process of Removal of Judges start when opposition bring the removal motion against Judges of Supreme Court And High Court it must be signed by 100 members of Lok Sabha and 50 members of Rajya Sabha and then this motion is send to the Speaker / Chairman. (2) Speaker / Chairman may admit or refuse to admit the motion (3) After The motion is admitted the Enquiry Committee is set up under Judges Enquiry Act (1968) and it consist of three members that are Supreme Court Judge or The Chief Justice Of Supreme Court, The Chief Justice Of High Court and Distinguist Jurist. (4) If the Committee founds the Judge guilty on the grounds of misbehavior and incapacity then the motion is further proceed (5) Then the motion is send to both houses of The Parliament and if it is passed by both the houses in special majority then the motion is send to The President.   30. Q. Explain the grounds and process of removal of judges of higher judiciary in India?
    According to Judge inquiry act 1968 there are two grounds on which judge of higher court can be impeached. These are-1. Proved misbehaviour 2. Incapacity as given in article 124 (4) of the constitution.
    The president can pass the removal motion of judge when addressed in Parliament by special majority.
    Stepwise process to remove judge of supreme court-
    1. The removal motion signed by 100 members (loksabha) or 50 members ( rajya sabha) is to given to the speaker/ chairman. Speaker/chairman may admit the motion or refused to admit it.
    2. If it is admitted, then the speaker/ chairman is to constitute a 3 member committee to investigate into charges. Committee should consist of chief justice or a judge of supreme court, chief justice of high court, distinguished jurist.
    3. If the committee finds the judge to be guilty of misbehaviour or suffering from an incapacity, the house can take up the consideration of the motion.
    4. Once the motion is passed by each house of parliament by special majority, an address is presented to the president for removal of the judge.
    5. Finally, the president passes an order removing the judge.
    Till date no judge of supreme court has impeached so far. The case of impeachment is that of Justice V Ramaswami of Supreme court (1991-1993) committee found him guilty of misbehaviour. He could not be removed as the impeachment motion was defeated in lok sabha. The recent case of impeachment of judge in Parliament was of Dipak Mishra but it is refused by chairman.
