Swarn singh committee recommended 8 fundamental duties for our constitution but the government added 10 fundamental duties in constitution by 42nd constitutional amendment and at present there are 11 fundamental duties present in our constitution.

44th संविधान संशोधन, 1978 में क्या प्रावधान हैं?
भारत देश में संकट की स्थिति का सामना करने के लिए संविधान द्वारा राष्ट्रपति को विशेष शक्तियाँ प्रदान की गई हैं. राष्ट्रपति को ये संकटकालीन शक्तियाँ या दूसरे शब्दों में संविधान के संकटकालीन प्रावधान अब तक बहुत अधिक संशोधन-परिवर्तन के विषय रहे हैं. 1975 में लागू आपातकाल में 42nd Amendment (1976) के आधार पर संकटकालीन प्रावधानों को और अधिक कठोर बनाया गया. लेकिन आपातकाल (emergency) में संकटकालीन प्रावधानों का जिस प्रकार से दुरूपयोग (misuse) किया गया, उसमें इन प्रावधानों के विरुद्ध प्रतिक्रिया उत्पन्न होना बहुत ही आवश्यक था. इसके अतिरिक्त 1977 में सत्तारूढ़ जनता पार्टी संविधान के संकटकालीन प्रावधानों में ऐसे परिवर्तन के लिए वचनबद्ध थी, जिससे वर्तमान या भविष्य के शासक वर्ग द्वारा इन प्रावधानों का दुरूपयोग न किया जा सके. 44वें संविधान संशोधन (44th Constitutional Amendment, 1978) द्वारा इस सम्बन्ध में आवश्यक व्यवस्थाएँ (provisions) की गई हैं और इस संविधान संशोधन के बाद वर्तमान समय में संविधान के संकटकालीन प्रावधानों की स्थिति निम्न प्रकार है –
Provisions of 44th Amendment
352 अनुच्छेद में व्यवस्था की कि यदि राष्ट्रपति का अनुभव हो कि युद्ध, बाहरी आक्रमण या आंतरिक अशांति के कारण भारत या उसके किसी भाग की शान्ति या व्यवस्था नष्ट होने का दर है तो यथार्थ रूप में इस प्रकार की परिस्थिति उत्पन्न होने पर या इस प्रकार की परिस्थिति उत्पन्न होने की आशंका होने पर राष्ट्रपति संकटकालीन अवस्था की घोषणा कर सकता था. संसद की स्वीकृति के बिना भी यह दो माह तक लागू रहती और संसद से स्वीकृत हो जाने पर शासन इसे जब तक लागू रखना चाहता, लागू रख सकता था. 44वें संविधान संशोधन (44th Constitutional Amendment) के बाद वर्तमान समय में इस सम्बन्ध में व्यवस्था निम्न प्रकार है –
अब इस प्रकार का आपातकाल युद्ध, बाहरी आक्रमण या सशस्त्र विद्रोह अथवा इस प्रकार की आशंका होने पर ही घोषित किया जा सकेगा. केवल आंतरिक अशांति के नाम पर आपातकाल घोषित नहीं किया जा सकता.
राष्ट्रपति द्वारा अनुच्छेद 352 के अंतर्गत आपातकाल की घोषणा तभी की जा सकेगी, जबकि मंत्रिमंडल लिखित रूप में राष्ट्रपति को ऐसा परमार्श दे.
घोषणा के एक माह के अन्दर संसद के विशेष बहुमत (अलग-अलग संसद के दोनों सदनों के कुल बहुमत और उपस्थिति और मतदान में भाग लेने वाले सदस्यों के दो-तिहाई बहुमत) से इसकी स्वीकृति आवश्यक होगी और इसे लागू रखने के लिए प्रति 6 माह बाद स्वीकृति आवश्यक होगी.
लोकसभा में उपस्थित और मतदान में भाग लेने वाले सदस्यों के साधारण बहुमत से आपातकाल की घोषणा समाप्त की जा सकती है. आपातकाल पर विचार करने के लिए लोकसभा की बैठक लोकसभा के 1/10 सदस्यों की माँग पर अनिवार्य रूप से बुलाई जायेगी. राष्ट्रपति द्वारा की गई संकटकालीन घोषणा को न्यायालय में चुनौती दी जा सकती है.
44वें संविधान संशोधन के पूर्व राज्य में राष्ट्रपति शासन की अधिकतम अवधि 3 वर्ष थी, लेकिन अब इस व्यवस्था में यह परिवर्तन किया गया है कि राज्य में राष्ट्रपति शासन के एक वर्ष की अवधि के बाद इसे और अधिक समय के लिए जारी रखने का प्रस्ताव संसद द्वारा तभी पारित किया जा सकेगा, जबकि इस प्रकार का प्रस्ताव पारित किए जाने के समय अनुच्छेद 352 के अंतर्गत संकटकाल लागू हो और चुनाव आयोग यह प्रमाणित कर दे कि वर्तमान समय में राज्य में चुनाव करवाना संभव नहीं है. किसी परिस्थिति में तीन वर्ष के बाद राष्ट्रपति शासन लागू नहीं रखा जा सकेगा.
इंदिरा गाँधी द्वारा शक्ति का दुरूपयोग
1975 में इंदिरा गाँधी द्वारा लागू किये गए 19 माह के आपातकाल में आपातकालीन शक्तियों का बहुत अधिक दुरूपयोग किया गया. इस स्थिति को देखकर आपातकालीन शक्तियों के दुरूपयोग पर अंकुश लगाने की आवश्यकता अनुभव की गई.
44वें संविधान संशोधन (44th amendment) द्वारा मूल संविधान की व्यवस्था में जो परिवर्तन किये गए हैं, उनसे राष्ट्रपति, प्रधानमंत्री या मंत्रिपरिषद के तानाशाह बनने की आशंका और भी निराधार हो गयी है. इस संशोधन के द्वारा ऐसी व्यवस्थाएँ की गई हैं कि भविष्य में शासक वर्ग के द्वारा निजि स्वार्थों की रक्षा के लिए (जो इंदिरा गाँधी ने emergency के समय किया था) आपातकाल लागू नहीं किया जा सके और आवश्यक होने पर जब आपातकाल लागू किया जाए, तब भी शासक वर्ग द्वारा शक्तियों का मनमाना प्रयोग न किया जा सके.
