What would be the impact of criminalizing the marital rape in case of minor by dropping the exception 2 in Section 375 of IPC?
It will be a sort of providing more wings to women in our society. Starting from the later vedic period, gupta age till now the status of women is not improved to that much. However, it was the watershed moment for our democracy when the Hindu Code Bill was introduced in our parliament. Our constitutional fathers have enshrined this in Article 15 that it is prohibited to discriminate on the basis of place of birth,caste,color,gender,religion,race.
Pros:
1. Coherence in POCSO Act 2012 and Prevention of child marriage act 2006 as this verdict will make the marriages of minor void.
2. Right to equality(in this case between a married girl child and unmarried girl child because latter possess the right to report the complain under sec 376 of IPC)
3. Art 21: Right to dignified living, body integrity and reproductive choice.
4. there are 40 millions child brides in our country, this move have a potential to totally eradicate the evil of child marriage.
5. The artificial distinction between married and unmarried girl child will be removed. Now she can assert her right to education art 21A as this move will criminalize the cohabitation of couple.
6. Reduction in teenage pregnancies—-MMR—-IMR.
Cons:
What will happen to those couples who are already married?
1. out of fear they can't access the medical aid in case of pregnancy or any other reproductive or associated problem.
2. it is a century old tradition, it would be better if court had adopted a graded approach through participative action of communities, panchayats and rewarding the families, couples for their steps in fighting the social evil. Because it is better to involve both sides i.e parents as well as children getting married. This verdict is kind of one sided order.
3. Misuse like Sec 498A
Conclusion:
Both Society and Government should readily accept this step as it is the progressive step towards a equitable and inclusive society. It is true that it is age old tradition but it has to be gone sooner or later.
